Terms and Conditions

1. Introduction

Welcome to the Manchester Community Jewish Cemetery ("the Cemetery") and the Greenfields Jewish Burial Society ("the JBA"). By registering and maintaining your membership, you agree to these Terms and Conditions ("T&Cs"). Please read them carefully.

2. Eligibility and Registration

Registration is open to individuals identifying as Jewish, in accordance with community standards and the determination of the JBA religious board. Registration requires accurate personal and family information, including confirmation of Jewish identity. The JBA reserves the right to verify eligibility and refuse or revoke registration if necessary.

2A. Family Coverage

Unless otherwise specified in writing, the Entry Fee and Annual Fee cover the registered member and their legally married spouse/partner (where applicable and registered). Dependents (children/unmarried offspring) are included in the member's registration until the day before their 25th birthday. Once a dependent reaches age 25, they must register as an independent member and pay the applicable Entry Fee to secure their own continuing burial rights.

3. Society's Responsibility and Commitment

The JBA commits to securing a reserved burial space, arranging all necessary burial procedures in strict accordance with Halacha (Jewish Law), and contributing to the overall upkeep, administration, and perpetuity of the Cemetery grounds. We commit to transparency in our processes and fees.

4. Burial Rights and Procedures

Burials are conducted in accordance with Jewish law and established community customs. All arrangements must be made through authorized JBA representatives. The JBA does not guarantee specific burial locations; allocation is determined solely by the JBA based on availability and sequence of need.

5. Non-Transferability of Burial Rights

Registration grants a non-transferable and non-assignable burial right solely to the registered individual and their included dependents. This right cannot be sold, gifted, or transferred to any other person, entity, or family member under any circumstance, except as explicitly required by Jewish Law or officially sanctioned by the JBA Board.

6. Fees and Payment Policies

• Entry Fee: An Entry Fee, determined by the individual's age at registration, is required upfront to secure the burial right. This fee is non-refundable.
• Annual Fee: An annual fee of £350 is due each year to maintain the account and contribute to the ongoing maintenance of the Cemetery. This fee must be paid by the end of each fiscal year.
• Failure to Pay: If the annual fee is not paid by the deadline, the account will receive one warning. If payment is not received following the warning, the account will become void, and the individual will need to re-register as a new account, paying the current Entry Fee and re-establishing eligibility.
• Payment Methods: All fees must be paid via approved channels. Alternative payment options can be made directly with the JBA office.

7. Cancellation and Refunds

The Entry Fee is non-refundable once paid, as it secures the right of burial. The registered individual may cancel their annual membership at any time by notifying the JBA office in writing. No refunds will be issued for annual fees already paid for the current or past years.

8. Family and Legal Authority

In cases of divorce, separation, or family disputes, the registered individual or their legal representatives are deemed authorized to make decisions regarding their account. The Cemetery and JBA shall not be responsible for resolving family disputes; legal proof of authority may be required.

9. Consent and Authorization

By registering, you consent to the collection and use of your personal data for necessary cemetery management, administrative tasks, and compliance with Halacha. The next of kin or authorized person agrees to carry out religious and legal procedures as required for the burial.

10. Conduct and Prohibitions

Respectful and appropriate behavior is required on the Cemetery grounds at all times. No vandalism, desecration, unauthorized digging, or other prohibited activities are permitted. The JBA reserves the right to remove any individual whose conduct violates Cemetery rules.

11. Monument and Marker Regulations

All monuments, grave markers, and inscriptions must comply strictly with the Cemetery's specific regulations regarding size, material, color, and religious content. Written approval from the JBA is required before any monument is ordered or installed. Any marker installed without approval may be subject to removal at the member's expense.

12. Liability and Limitations

The Cemetery and JBA shall not be liable for damages arising from circumstances beyond our reasonable control, including, but not limited to, acts of nature (e.g., storms, subsidence), war, vandalism, or unauthorized third-party actions.

13. Data Privacy

Personal data will be handled in accordance with applicable privacy laws. Data may be shared with authorized community representatives, Rabbinic authorities, and government agencies as necessary for the fulfillment of our services and legal compliance.

14. Amendments to Terms

The JBA reserves the right to update or amend these T&Cs. Continued use of your membership signifies acceptance of any changes. Members will be notified of any significant changes via mail or email.

15. Dispute Resolution

Disputes shall first be resolved amicably through mediation with the JBA Board. Unresolved issues may be submitted to beth din (religious court) or arbitration under applicable civil laws of the jurisdiction.

16. Miscellaneous

These T&Cs constitute the entire agreement between the JBA, the Cemetery, and the registered individual concerning the subject matter herein. If any provision is invalid, the remaining provisions remain in full effect.

17. Governing Law

These T&Cs are governed by the laws of the jurisdiction in which the Manchester Community Jewish Cemetery is situated, as well as the rules of Jewish Law (Halacha) as determined by the JBA's religious leadership.
